These Terms of Service (“Terms”) govern your access to and use of Sanctuary on the Sea’s website, services, and products (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree to these Terms, you may not access or use our Services.

1. Acceptance of Terms

By accessing our website or using our Services, you represent that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into binding contracts
  • You will comply with all applicable laws and regulations
  • All information you provide is accurate and current

2. Use of Services

2.1 Permitted Use

You may use our Services for lawful purposes only and in accordance with these Terms. You agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit harmful, offensive, or unlawful content
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of our Services
  • Use automated systems to access our Services without permission

2.2 Account Registration

Some Services may require account registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3. Yacht Charter Services

3.1 Charter Agreements

All yacht charters are subject to a separate Charter Agreement between you and the yacht owner. We act as a broker and are not the owner or operator of the yachts. The Charter Agreement governs the terms of your charter, including payment, cancellation, and liability.

3.2 Booking and Payment

Charter bookings require:

  • A signed Charter Agreement
  • Payment of a deposit (typically 50% of charter fee)
  • Payment of Advance Provisioning Allowance (APA)
  • Final payment 6-8 weeks before charter date
  • Proof of charter insurance (recommended)

3.3 Cancellation Policy

Cancellation terms vary by yacht and are specified in your Charter Agreement. Generally:

  • Cancellations 90+ days before charter: May receive partial refund
  • Cancellations 60-89 days before charter: Typically 50% refund
  • Cancellations within 60 days: Generally no refund
  • We strongly recommend purchasing cancellation insurance

4. Yacht Brokerage Services

4.1 Representation

We provide yacht brokerage services for buyers and sellers. Our services include listing, marketing, negotiations, and transaction facilitation. A separate brokerage agreement will govern the specific terms of our representation.

4.2 Information Accuracy

While we strive to provide accurate information about yachts, specifications and details are provided by yacht owners and manufacturers. We do not guarantee the accuracy of all information. Buyers should conduct their own due diligence, including professional marine surveys.

4.3 Commission

Brokerage commission is typically paid by the seller and is specified in the listing agreement. Commission rates are negotiable and will be clearly stated in writing before any services are rendered.

5. Refit and Maintenance Services

Our refit services are governed by:

  • Written estimates and scope of work
  • Separate service contracts for major projects
  • Change orders for any modifications to agreed work
  • Payment schedules based on project milestones
  • Warranty terms specific to work performed

6. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Sanctuary on the Sea or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of our content without express written permission. Limited use for personal, non-commercial purposes is permitted.
